Five face jail over price fixing

The OFT announced late last week that it has charged five individuals with offences under the Enterprise Act 2002 in relation to price fixing in the UK market for passeger transport services provided by British Airways and Virgin.

Readers will recall that this story first hit the headlines some time ago and that there have been investigations about what took place by the competition authorities. These charges are a reminder and warning to excutives that anti-competitive practices involving ‘cartel’ type activity such as price fixing, bid rigging, and dividing up the market can lead - and based on the current drive by the competition authorities will lead - to individuals being prosecuted as well as businesses being subject to servere fines.
