Loudspeaker design registered as a trade mark
The European Court (Court of First Instance) has overruled a decision of the European trade mark registry and allowed a distinctive design of loudspeaker by Bang and Olufsen to be registered as a trade mark. The key to this decision is a finding that the design is inherently distinctive. Several applications to register the shapes of products – eg the shapes of toasters, electric shavers – have been rejected because the shapes were not sufficiently distinctive to be registered as a trade mark.
